Cumbrian residents instruct Hugh James for environmental group action

Leading UK law firm Hugh James has been
instructed by local residents to pursue a group legal action
against Alba Proteins (Penrith) Limited. The legal action
is for compensation in relation to the odour nuisance alleged
to be emanating from their Wildriggs site located in Penrith,
Cumbria.
The claim will be for compensation for loss of enjoyment of
the residents' homes caused by the odour.
Residents have long complained that the odour
has interfered with the enjoyment of their properties and
has prevented them from activities such as being able to sit out in
their garden and being able to open windows and doors in the
summer.
The odour is so notorious in the community that the locals have
dubbed it the "Penrith Pong".
As well as seeking compensation on behalf of the residents, Hugh
James will also be seeking an injunction to prevent the
continuation of the nuisance in future if there is evidence in
support of such a claim.
Hugh James will be holding the following meetings for any
residents who feel they have been adversely affected by the odour
alleged to emanate from the Wildriggs Site or who would like
further details about the claim.
Case meeting – 15th June 2011 at 7pm
at the Castletown Community Centre. This will be a meeting to
discuss details of the case and outline possible ways forward for
the community.
Drop in clinic – 22nd June 2011
between 2pm and 8pm at Castletown Community Centre. Residents will
have the opportunity to discuss the case and practicalities of
being part of the group action.
Residents must remember that the Court has set a cut-off date of
30th September 2011, and after this date the Court will
not permit any residents to join the group action. As there are a
number of steps to go through to register a claim, residents should
contact Hugh James as soon as possible to make sure they are fully
registered in good time.
