A case win following a misdiagnosed cerebro-spinal fluid leak
Sarah Davies a specialist medical negligence solicitor at

concluded a case totalling £150,000 for a Devon based client. The
client underwent a spinal operation in 2007 and sustained a dural
tear causing cerebro-spinal fluid to leak. In itself this is a
recognised complication, however in this case a delay in diagnosing
and treating the dural tear and cerebro-spinal fluid leak led to
the client being discharged from hospital without further
treatment.
The client was readmitted to hospital on discovery of the dural
tear and cerebro-spinal fluid leak during which time he encountered
further delays. Once the problem was diagnosed, he underwent
numerous operations to try and correct the leak. Due to the delay
in treatment the client developed a severe infection in his spinal
disks leading to permanent back problems. This case of
clinical negligence has resulted in the claimant not being able to
return to work. He will also require ongoing care and
assistance.
