Fractures

If you are suffering from broken bones you are likely to attend the Accident and Emergency department at a local Hospital for emergency treatment.

Often these departments are very busy and mistakes can be made and breakdowns in communication may occur.

Sadly mistakes are made by many medical professionals resulting in pain, heartache and frustration for victims and their families.

Hugh James’ clinical negligence specialists comprise an experienced team, dedicated to helping victims of all types of medical negligence. If you have been harmed as a result of poor medical judgment you may be able to claim compensation for clinical negligence.

Fracture types

Fractures of bones can occur in one of two ways, either a fracture is caused by one large exertion of force on a bone or through a series of smaller exertions of force, which repeat to cause a break in the bone (stress fractures).

Types of fractures are numerous and can affect the type of treatment that is appropriate in each individual case.

Therefore it is important that in each individual case the patient gets the treatment that is best suited to the fracture that they have suffered.

The severity and location of a fracture can affect the way in which the fracture is fixed.   Types of fixing include casts, plates, screws, rods or external fixing.

Negligence claims

Clinical negligence claims relating to fractures therefore tend to fall into two distinct categories:

Failure to diagnose – This can include a failure to take an X-Ray when it was appropriate to do so or misreading an X-Ray so that a fracture is missed.

Incorrect Treatment After Diagnosis – This can include offering conservative treatments to initially treat a fracture when more proactive methods are required.

If fractures are misdiagnosed or incorrectly treated then the complications can be quite serious. Some fractures may lead to infections such as osteomyelitis or in severe cases a delay in treatment can lead avascular necrosis (bone death). Therefore it is important that a fracture is diagnosed quickly and correctly.

Falls

Falls can be caused by numerous medical conditions/ medication interactions. The NHS website dictates that any patient who goes for a check-up or treatment because of a fall or problems with balance or walking should be given a ‘falls risk assessment’.
