Rehabilitation

Rehabilitation focuses on enabling an injured individual to regain control over their body and life. The aim is to enable the injured person to live as independently as possible and to enable them to make their own decisions about what to do, when to do them and how. Time limits

Different types of cases have different time limits in which they have to be pursued. If the wrong time limit is applied it can have devastating consequences for your claim.  The law in relation to this area is very complex but it is fair to say that time really is of the essence. Compensation

If your claim is successful, you will receive an award of damages, often called compensation. The aim of compensation is to put you, as far as possible, in the same position that you would have been in had the accident not occurred.  The amount of compensation varies in each case. Interim payments

Claims for damages following severe injuries will often take a number of years to be resolved, not least because it can take a considerable time for the medical position to be clarified and future needs to be identified.

Interim payments are therefore very important to the injured person, their families and carers. These payments are necessary both to assist financially during this difficult period and also to ensure that any care and rehabilitation can be paid for. Stephen Webber, Head of Clinical Negligence and Partner at Hugh James comments on the recent Bridgend teenager who received £6.5 million in compensation after being left with cerebral palsy:

 

" This is a tragic case and it not clear why it has taken so long for this case to be resolved as I would not have expected a case to take this long. Clinical Negligence cases are very complex and it can take a number of years for cases to resolve particularly when the defendents fight the case and the extent of the Claimant's disabilities are developing over a long time.
 
Many people will think that £6.5 million is a huge sum of money but this compensation will not be paid in one lump sum but there will be a smaller lump sum then annual payments for the rest of the Claimant's life. The compensation will have to pay for 24 hour care for the rest of the Claimant's life. This type for care package can cost hundreds of thousands of pounds every year."
