Undiagnosed / misdiagnosed cancer compensation

Nowadays, advances in medicine have meant that many cancers are now treatable.   However, this is reliant on when the cancer is diagnosed and when the appropriate treatment is commenced. The earliest possible detection of cancer can be very important and will sometimes be the key to whether the person will make a recovery or not.

When there is a delay in diagnosing cancer, a person may be deprived of their chance for treatment and / or cure.   They may also be deprived of the opportunity for palliative care.

Medical negligence claims involving cancer can often involve one of the following factors

  • Failing to diagnose cancer

This can be due to a Doctor missing or misinterpreting symptoms or misinterpreting test results.

  • Delay in Diagnosis     

This could be caused by delay in referring someone to a specialist, failing to act quickly enough in relation to test results or delay in carrying out biopsies, amongst other.

  • Misdiagnosis

Some people may be diagnosed as having cancer when they do not in fact have it.   This could lead to evasive and painful treatment such as chemotherapy being carried out unnecessarily.

Case summary 1:
Stephen Webber, head of medical negligence recovered £330,000 for the family of a Merthyr Tydfil woman whose cancer was mis-diagnosed when the hospital failed to appropriately diagnose her cancer from a biopsy which resulted in a  delay in treatment which eventually caused our client's death.  The money ensured financial security for her children.

 

Case summary 2:
Partner and medical negligence solicitor Hannah Williams, recovered £4m for a client following a delay in acting upon a scan which suggested a lump that he had might have been cancerous. The lump was cancerous and, as a result of that delay, the surgery that he ultimately needed was far more extensive than it would have been had it been carried out months earlier and he was left significantly disabled. Our client received a large lump sum and annual payments for the rest of his life to meet the cost of private 24 hour care and a new property.


 

Case summary 3:

Medical neglience partner, Hannah Williams, recovered £500,000 on behalf of  a client from Newcastle following a delay in treating an infection. Our client fractured his leg and underwent surgery to repair the fracture. Following the surgery there were signs that he had an infection in the wound. This was not acted upon quickly enough and our client ultimately underwent a vast number of operations to try and eradicate the infection, which culminated in a full hip replacement. His mobility was permanenly affected and he could not walk without a stick. He was unable to return to work.
