We were instructed on behalf of
Pennant Walters (Maesgwyn) Limited (part of the Walters Group of
Companies) in connection with its numerous wind farm projects
across South Wales. Most notably, the Maesgwyn Wind Farm will
consist of 13 wind turbines which will produce up to 26 megawatts
of electricity and will supply clean energy to the equivalent of
approximately 25,000 homes.
Advising Welsh/German Investors in
a joint venture in relation to the development of wind farm
projects in Wales. Work included drafting and advising on the EPC,
turbine supply, civil and mechanical/electrical operations and
maintenance contracts.
We were instructed to review and
advise Welsh Water on its substantial supply chain structures and
commercial contracting arrangements. This included advising on
procurement processes, tender documentation and compliance with the
Utilities Contract Regulations. This was a significant piece of
work which was of some importance to the client.
Advising British Nuclear Fuels on
the renegotiation of its long term commercial agreements to supply
nuclear fuel to British Energy.
Advising private equity firm Terra
Firma on its £453m recommended acquisition of East Surrey Holdings,
holding company for Sutton and East Surrey Water
The team has also been involved in
consultations with the Director of Energy for the
Welsh Government in relation to the same matter. This is a
significant piece of work involving advising on environmental
issues as well and involved partner Neil Stockdale
We provided advice to the Environment Agency on the procurement
process and preparation of the contractual documents for the
development and provision of a managed flood warning service known
as Floodline Warnings Direct. This system allows local authorities
to provide information on flooding to its citizens via the
Environment Agency Floodline Service.
We have been involved in acting on behalf of landowners in
respect of the following wind farm projects:
- Pencader (Force 9 Energy Ltd formerly Catamount Cymru Cyf) - 9
separate landowners
- Parc Cynog (Nuon UK Limited formerly Micon UK Ltd and M and N
Projects Ltd) - 3 separate landowners
- Llanfynydd (Gamesa) - 11 separate landowners
- Brechfa/Trawscoed (N Power (aborted following Forestry
Commission Tender - but discussions ongoing at time of compilation
with other potential developers)
- Bedlinog (Tegni Cyf - 1 landowner)
- Rhos Garn (Renewable Energy Systems Limited - 1 landowner)
Advising on matters from
compensation claims and injunctions, access rights and disputes
about the unauthorised diversion of public sewers or interference
with public water mains.
