Medical Mistakes
Get a second opinion
The only good thing about falling ill is the feeling of getting better. Once illness strikes, we put our trust in the medical profession to get us quickly back on our feet. This trust is usually rewarded with a successful diagnosis and a good prognosis for recovery. However, in a very small minority of cases, recovery takes much longer than expected and clinical negligence could be at fault.
Last year, some 800,000 adverse events relating to the NHS occurred, with about 6,000 of these complaints involving litigation and compensation payments. If you feel you have such a case to bring against the medical profession you will need advice from a solicitor’s firm that is not afraid of taking on large institutions.
Clinical Negligence Expertise
Clinical Negligence is a specialist service offered by Hugh James to represent victims of the medical profession’s failure to reach an expected standard of medicine. Whilst prescribing incorrect treatments or drugs are easier to prove, some mistakes such as poor techniques during surgery are often difficult to detect.
Hugh James is one of a handful of legal firms to have been awarded a Clinical Negligence Franchise and our team includes members of the Law Society’s Medical Negligence Panel and Action against Medical Accidents.
Clinical Negligence Issues
You will need to show that you have a reasonably strong case. You will need to prove your doctor, hospital or clinic had fallen below the expected standard, that you suffered physical or mental injury and suffered other losses such as out-of-pocket expenses.
A three year time limit from the date of a medical accident (or discovering about it) is the usual cut - off point for bringing a case. However in cases involving children the clock does not start ticking until they are eighteen.
Clinical Added Value
In addition to our specialist solicitors we also have experts in their particular fields, including qualified nurse executives, welfare benefits advisers, a medical records officer, speech and language therapist and a case worker who is a qualified social worker and expert in the field of disability.
We believe in flexibility and are happy to arrange a free interview in the first instance whether in our offices, at your home or even in hospital. Before proceeding with any claim we can advise you of any entitlement or assistance that may be available through the community legal service, personal insurance cover or even how to proceed on a ‘no win, no fee’ basis if suitable.
