Valuing a Claim
If your claim is successful, you will receive compensation. The aim of compensation is to put you, as far as possible, in the same position that you would have been in had your asbestos condition not developed.
The amount of compensation varies in each case. However, damages are awarded in two separate categories:
General Damages
General damages are designed to compensate you for the pain and suffering that you have experienced and the effects that your disease has had on your day to day activities.
Special Damages
Special Damages are designed to compensate you for your financial losses and expenses from the date your symptoms began to trial and for any future ongoing financial losses. There is no financial limit on the level of these damages.
Such damages can include:
- Loss of earnings
- Private medical expenses and therapy
- Costs of aids and equipment
- Travelling expenses
- Care costs
- Loss of pension rights
- Transport costs
