Time Limits
Different types of cases have different time limits in which they have to be pursued. If the wrong time limit is applied it can have devastating consequences for your claim.
The law in relation to this area is very complex but it is fair to say that time really is of the essence.
The time limits for court cases are set out by statute.
In asbestos claims the three year time limit generally begins to run from the date of diagnosis of an asbestos-related condition, although it can sometimes be earlier where, for example, someone is suffering breathlessness and knows, in their own mind, that their symptoms are somehow connected to their asbestos exposure.
Where someone dies their next of kin can usually bring an action within 3 years of the date of death.
There are notable exceptions to these time limits and you should always contact a solicitor as soon as possible to seek advice in relation to this issue.
