The drug Vioxx (rofecoxib) a widely used painkiller and anti inflammatory medication, has been withdrawn by the manufacturers Merck Sharp and Dohme following concerns raised in a long term study that showed an increased risk of heart attack and stroke after a period of 18 months or more prescription.

The New Jersey State Court where the UK citizens had filed their claims against Merck has granted Merck’s application that the claims should be dismissed on the basis that they should be pursued in the United Kingdom.

Mark Harvey, a Partner bringing these cases commented:

"This is a very disappointing decision.  We felt strongly that Merck and its drug should be scrutinised in its own back yard and that UK citizens should be given equal treatment to that of the American ones.  We shall now consider our options with our American and UK partners before deciding what further steps we shall take".
