Funding a Claim
There are a number of ways of funding your case.
Public funding (legal aid) is generally no longer available for personal injury actions.
The following are the main options available to you for funding your claim:
- Legal Expenses Insurance. For example incorporated within your home or motor insurance policy.
- Through a Trade Union or other professional body of which you are a member.
- Conditional Fee Agreement (‘No Win, No Fee’):
- If you win, the defendant is responsible for paying your legal costs.
- If you lose you pay nothing.
- Private fees (‘Pay as You Go’). This option is rarely the best and will only be used if none of the above options are suitable for you.
The various funding options for a personal injury claim can seem quite complicated. Do not be put off seeking legal advice about a potential claim solely as a result of concerns about meeting potential legal costs.
