The government has lost its appeal against the
High Court ruling that the proposed FIT cuts were unlawful. The
Court of Appeal has confirmed today (Wednesday 25 January) that the
High Court’s decision still stands.
In October last year, the government announced
that it planned to reduce the tariff on installations after 12
December 2011, 11 days before the consultation period was scheduled
to close.
The government is now seeking permission to
take the case forward to the Supreme Court. Details of whether this
will be granted will be released within the next few days.
Ioan Prydderch, Head of Hugh James Energy Team
says ‘This announcement brings good news to the industry. However,
the uncertainty continues due to the appeal. Hugh James is advising
a number of public and private sector bodies who have an active
interest in this matter and are all anxiously awaiting the final
outcome.’
