The Government is set to appeal after High
Court Judge, Justice Mitting, yesterday (21 December
2011) ruled the DECC decision to cut the Feed-in-Tariff rates
as unlawful.
The Government has already said it will seek
leave to appeal the decision following its issue of a consultation
on the change in October.
Justice Mitting said the decision by the
Government to reduce the tariff from the 12th December,
11 days before the consultation period was scheduled to close (this
Friday), was unlawful.
Ioan Prydderch, Head of Hugh James Energy Team
says “The immediate impact this will have on businesses and
consumers installing renewable energy technologies under the FIT’s
regime remains uncertain following the decision made this afternoon
due to the potential for the decision to be reversed on appeal.
However, this clearly puts pressure on the government and validates
the concerns expressed by so many in the industry about the way in
which the government has sought to introduce these changes”.
