Norton Aluminium Group Litigation
Hugh James has been
appointed the lead solicitors in the Norton Aluminium Group
Litigation.
The firm has been
instructed by over 130 local households to pursue claims for
compensation in relation to the odour, dust and noise nuisance
which emanates from the Norton Aluminium foundry in Norton Canes,
near Cannock. The residents will also invite the Court to grant an
injunction to stop the problems from happening in the future.
The residents say that
they suffer loss of enjoyment of their home caused by the nuisance
which includes issues such as not being able to open windows and
doors in the summer, not being able to sit out in the garden and so
on. Some residents also claim that the fallout from the site is
damaging their windows, cars and other property.
The case came to trial
before His Honour Judge McKenna in July 2011 but was adjourned on
the fourth day. McKenna J ordered a stay of proceedings to
allow for settlement negotiations, but this was lifted at the end
of September 2011 when these negotiations failed. The trial is
expected to resume in May 2012 following the preparation of further
witness statements and experts’ reports in relation to the extent
of the nuisance.
