Making a nursing care claim
What’s the legal process for making a nursing care claim?
There are lots of reasons why NHS
continuing healthcare decisions may be wrong. If you are paying for
your own care and have been refused funding then you may be able to
reclaim these fees.
The first step is to complete
our online form or contact the nursing care team on 029 2039
1108 or email nursing.care@hughjames.com
giving us an overview of your situation. Using this information we
will be able to let you know if you have a claim.
You will not have incurred any
costs at this point; our free assessment will help you decide
whether to challenge the decision on your care home fees and there
is no obligation to proceed.
One of our specialist team members
will be your dedicated expert, managing your case from start to
finish, giving advice and keeping you updated about your claim
every step of the way.
How are nursing care claims
funded?
We initially assess all claims by a
written questionnaire. This first assessment is free and
confidential and there is no obligation on you to proceed.
There are a number of different
ways in which a claim may be funded. Which method of funding the
claim is the most appropriate will depend on personal
circumstances. Usually, a claim will be funded in one of the
following ways:
- On a private paying
basis
- Legal Expenses Insurance
- Contingency Fee Agreements (CFA) –
“no win no fee”
- Trade Union funding
