Role and Responsibilities of a Deputy

 

  • Act at all times in the best interests of the person concerned. 

  • Safeguard the person’s assets.

  • If they do not live with the person, visit them regularly and take an interest in their welfare.

  • Identify and provide for all the person’s personal needs from their money.

  • Work closely with the person’s carer (if applicable), ensuring the best quality of life within the funds available.

  • Claim any benefits or pensions to which the person is entitled.

  • Liaise with the Court of Protection or the Office of the Public Guardian about the person’s financial needs.

  • Keep any property in a reasonable state of repair, secure and adequately insured and oversee any sale or letting if needed.

  • Open and operate a deputy bank account for the person.

  • Ensure that all income is collected and bills are paid on time.

  • Maintain financial records and prepare annual accounts on time.

  • Deal with the person’s income tax and other tax matters.

  • Take out insurance (through a security Bond) to cover his/her dealings with the person’s funds, and pay the premium promptly when required.

  • Notify the Office of the Public Guardian of any changes in the person’s financial situation, for example, if he or she inherits any property or money.

  • Notify the Office of the Public Guardian if there is a likelihood of the person getting married, divorced or involved in other legal proceedings.

  • Co-operate with any Court of Protection Visitor – the Visitor is an independent person who may visit the incapacitated person to ensure that the receivership is working smoothly.

  • Comply promptly with all directions given by the Court of Protection or the Office of the Public Guardian.
