Hospital negligence including hospital acquired infections, surgery and operations

Case summary 1:

Rhian Parsons, medical negligence senior associate recovered £53,500  for a client from Rhondda Cynon Taff who had contracted MRSA following spinal surgery. The compensation provided much needed equipment and support for the client's family who provided her with care.
 
Case summary 2:
Rhian Parsons, medical negligence senior associate, recovered £645,000 for a Cardiff based client who had contracted MRSA and as a result had been left virtually wheelchair bound. The compensation enabled the client to purchase an adapted property and meant that professional carers could look after her for the rest of her life.
 
Case summary 3:
Medical negligence senior associate Rhian Parsons recovered £16,000 for a client from Gwent who had developed pressure sores as a result of negligent treatment whilst he was in hospital recovering from a Road Traffic Accident.

Case summary 4:
Negligence solicitor Elin Davies recovered £6000.00 for a family from Brecon whose elderly relative fell at hospital. She was left unaided and as a result sustained injuries which caused a deterioration in her condition. She sadly passed away shortly after the fall. The damages awarded were in relation to her pain and suffering and funeral expenses.

Case summary 5:
Medical negligence solicitor, Elin Davies, from the Hugh James specialist medical negligence team recovered £10,000.00 for our client from Weston Super Mare. The compensation was in relation to injuries sustained as a result of an operation to our client’s ankle. There was also a failure to provide appropriate follow up treatment and care which resulted in a prolonged period of recovery and caused unnecessary discomfort.

Case summary 6:

Specialist medical negligence solicitor Sarah Davies has recovered £150,000 for a Devon based client who suffered a dural tear after a spinal operation in 2007. The dural tear caused cerebro-spinal fluid to leak, which in itself is a recognised complication however in this case a delay in diagnosis and treatment led to the client sustaining permanent back problems. Missed fractures negligence

Case summary 1:

Elin Davies, solicitor in the medical negligence department, recovered £3,500.00 in respect of a missed fracture of our client’s foot. Our client,  who is from Cambridge, attended the hospital with a painful foot, yet there was a failure to correctly diagnose the injury and to adequately review x-rays. The missed fracture resulted in a delay in treatment and a prolonged recovery period.

Solicitor Stephen Webber, who is head of the Hugh James medical negligence department, recovered £50,000 for our Carmarthen client where the hospital failed to diagnose a fracture  to his arm when he went to accident and emergency.  This resulted in a delay in treatment and ongoing problems.

Medical negligence solicitor and head of the Hugh James negligence department, Stephen Webber, recovered £60,000 for our Aberdare based client who had a mis-diagnosed scaphoid fracture.  Our client attended the hospital after a fall which resulted in a painful wrist. The doctors failed to diagnose a fracture to his wrist which resulted in a delay in treatment and ongoing problems of weakness in his hand and wrist.

Rhian Parsons a solicitor in the Hugh James specialist clinical negligence team has recently concluded a case for a London based client. A settlement of £30,000 was awarded to our client who has suffered on going complications after a misdiagnosed fracture injury.

Obstetric, birth injuries and cerebral palsy negligence

Case summary 1:
Hugh James medical negligence senior associate Rhian Parsons recovered £700,000 for a London mother whose child was born with spina bifida where the condition should have been diagnosed during the pregnancy. The money enabled the family to buy a house and funded equipment which the child needed

Head of the Hugh James medical negligence department, Stephen Webber, recovered £4m on behalf of our Newport based client who suffered from cerebral palsy as there was a negligent delay in delivering our client which resulted in oxygen starvation and severe brain injuries .The compensation allowed for our client's family to purchase her a property as well as all of the equipment she required for her future.  It also allowed her to have a team of carers to look after her for the rest of her life.

Stephen Webber head of medical and clinical negligence at Hugh James, recovered £60,000 for Cardiff parents who lost their child shortly after it was born.  There was a negligent delay in delivering the baby which,if avoided,  would have resulted in the baby surviving.  The compensation recovered was for the bereavement award, psychiatric injuries as well as loss of earnings.

Cancer misdiagnosis and late diagnosis of cancer

Case summary 1:
Stephen Webber, head of medical negligence recovered £330,000 for the family of a Merthyr Tydfil woman whose cancer was mis-diagnosed when the hospital failed to appropriately diagnose her cancer from a biopsy which resulted in a  delay in treatment which eventually caused our client's death.  The money ensured financial security for her children.

Case summary 2:
Partner and medical negligence solicitor Hannah Williams, recovered £4m for a client following a delay in acting upon a scan which suggested a lump that he had might have been cancerous. The lump was cancerous and, as a result of that delay, the surgery that he ultimately needed was far more extensive than it would have been had it been carried out months earlier and he was left significantly disabled. Our client received a large lump sum and annual payments for the rest of his life to meet the cost of private 24 hour care and a new property.

Case summary 3:

Medical neglience partner, Hannah Williams, recovered £500,000 on behalf of  a client from Newcastle following a delay in treating an infection. Our client fractured his leg and underwent surgery to repair the fracture. Following the surgery there were signs that he had an infection in the wound. This was not acted upon quickly enough and our client ultimately underwent a vast number of operations to try and eradicate the infection, which culminated in a full hip replacement. His mobility was permanenly affected and he could not walk without a stick. He was unable to return to work.

Nursing care negligence and elder abuse

Case summary 1:

Assistant Solicitor, Elin Davies recovered £4,000.00 for the London based family of an elderly man who was not adequately supervised by nursing staff and sustained an injury when he fell out of bed.  The award was in relation to his pain and suffering which could have been avoided with more appropriate nursing care.

Delays in medical treatment

Case summary 1:
Head of medical and clinical negligence at Hugh James solicitors, Stephen Webber, recovered £3.3m on behalf of our London based client where there was delay in treating an infection in our client's back which resulted in paraplegia.  The compensation allowed our client to purchase an adapted property and also all the equipment and care that she required for the rest of her life.

Dental treatment

Gynaecological surgery

Hannah Williams, medical negligence solicitor and Hugh James partner recovered £475,000 for a female client who lives in Cardiff  as a result of gynaecological surgery which led to her bowel being damaged. She was unable to return to her previous employment, had a temporary colostomy, and was left with long term bowel dysfunction, and suffered from depression.

Negligent bowel and colorectal surgery

Case summary 1:
Stephen Webber head of medical and clinical neglience at Hugh James Solicitors, recovered £70,000 on behalf of our client from Exeter who had negligent bowel surgery.  The surgery caused our client to suffer from a significant period of recovery and had to undergo further operations because of the negligent surgery.

Case summary 2:
Medical negligence partner Hannah Williams, recovered £1.1m for a client from the South Wales valleys as a result of negligently performed bowel surgery. As a result of the surgery the client suffered from severe peritonitis. She had to remain in hospital for over two years. Her mobility was severely affected as a result of her long term illness and she was left with a permanent stoma, which leaked repeatedly.

 
 

Premature amputation

Partner and solicitor in the medical and clinical negligence team, HannaWilliams, recovered £145,000 for a client from Cwmbran following the amputation of his leg. The client was a diabetic and had been fitted with specialist diabetic shoes, which did not fit him properly. The shoes rubbed and caused blisters on his feet which, because of his diabetes, would not heal. It was accepted that because of the diabetes the client would have lost his leg in the future in any event but that the amputation had been brought forward by a significant number of years.
 

Failure to provide appropriate medication

Hugh James Solicitors head of medical negligence, Stephen Webber, recovered £7.8m for a young Cardiff girl following a failure to provide appropriate anti-epileptic medication which resulted in severe brain injury.  Our client received a large lump sum and annual payments for the rest of her life which allowed her to have 24 hour care, alterations to her property and all the equipment that she required to cope with her injuries in the future.
 

Cataract surgery

Medical negligence solicitor, Elin Davies, recovered 40,000.00 in respect of injuries sustained by our client, who is based in Cumbria, during cataract surgery. The consent process and the management of the operation were substandard and as a result our client endured a significant deterioration in relation to her vision which had a considerable impact on her enjoyment and quality of life.
