Compensation for client buried alive on first day of work
Compensation just short of £100,000 has been recovered for a
Hugh James client who was buried alive on his first day at
work.
Cenric Clement-Evans and Richard Antuch have successfully
recovered damages in the sum of £98,000 for one of their clients
who sustained serious injuries as a result of an accident at work
in February 2007.
On the morning of his first day work as a
Groundworker, our client was taking a measurement in a trench to be
used to redirect sewerage when the sides of the 2½ metre high bank
gave way and collapsed in on him, burying him alive.
Mr D was extremely fortunate to have survived
the incident. His injuries included a fractured collar bone,
fractured ribs, injuries to his vertebrae and a pneumothorax (a
punctured lung).
Unsurprisingly he also sustained significant
psychological injuries and was diagnosed with Post Traumatic Stress
Disorder.
Richard Antuch commented, “Our client was
delighted with the result, as initially he was offered only £25,000
to settle the case and eventually recovered almost 4 times the
original offer. We were very pleased that in addition to the
compensation we had been able to obtain several interim
compensation payments to assist his financial needs, as well as
arranging treatment from an expert psychologist (Cognitive
Behavioural Therapy). Our client found this extremely helpful and
now hopes to be able to return to work.”
