RICS Matrics were at Hugh James’s offices this morning to talk about tactics in dilapidations claims. RICS Matrics describes itself as a “youthful, forward thinking, challenging, nurturing, vibrant” organisation. Rhodri Thomas was therefore the perfect member of the Property Litigation team to lead the discussions (he has certainly been described as ‘challenging’ on more than one occasion!).  We shared ideas about recent trends in dilapidations cases and about how surveyors and lawyers can work in partnership to achieve the best, most cost-effective settlements for both our landlord and tenant clients. There was discussion of the Pre-action Protocol for Dilapidations which has been a requirement of court rules for some time now. We discussed how to approach situations where our clients are stuck in the middle of a dilapidations dispute where they are a head-tenant with a mirror repairing obligation in the sub-lease. There was particular interest in the question of how to approach a limited repair obligation where the schedule of condition consists of some grainy black and white photographs of a heavily patch repaired roof which is now beyond economic repair and requires replacement.

All of the above came whilst tucking into bacon rolls, coffee and pastries. And did we mention Rhodri’s hole in one on the golf course last weekend? If you haven’t heard yet then get in touch as Rhodri would be more than happy to explain (and, to be frank, it would give the rest of us a break!).
