Buckden North Landfill – odour nuisance
We are currently investigating the possibility of pursuing a civil claim on behalf of residents in your area against the operators of Buckden North landfill in relation to odour nuisance which is alleged to have emanated from the site, located on Station Farm, Brampton Road, Buckden, St Neots, PE19 5UH. Residents have made us aware of the problems affecting them in the locality of the site and wish to take legal action.
The proposed action would be for compensation for past (and any ongoing) loss of enjoyment of your home caused by the odour from the site and, if unreasonable odour nuisance is continuing, possibly an injunction to ensure that the site brings the odour to a reasonable, tolerable level. The court expects an element of “give and take” between neighbours, and as such will not endorse a zero tolerance to occasional odours from the site. Based on our investigations to date it is our understanding that odours experienced in the community have exceeded what may be considered reasonable.
The aim of the claim is to ensure that Buckden North landfill is being operated with due respect to its neighbours and without emitting excessive odour levels in the neighbourhood. It is not the aim of the claim to close the site down or to cause job losses.
