Legacy contamination and regulatory oversight

Many contamination issues arise from historic industrial activity, sometimes decades after the original operations ceased. Local authorities have a statutory duty to identify and inspect potentially contaminated land and, where appropriate, to determine and remediate it under the Environmental Protection Act 1990. In practice, however, identifying and investigating contaminated sites can be complex and resource-intensive. Public bodies often face funding and capacity constraints, meaning that some sites are not fully investigated unless redevelopment occurs or specific complaints are raised. Where contamination remains present and affects residential property, private legal action may become an important route for affected communities to seek clarity, accountability and appropriate remediation.


How land contamination claims arise

Land contamination claims commonly involve:
