Our team has extensive experience of advising clients in a wide range of projects from housing, commercial and retail to infrastructure, transport and renewable energy. We also carry out due diligence work for funders involved in development or project finance.

Ioan is head of the firm’s business services division, which comprises all of the teams which provide transactional, contractual, advisory and dispute resolution advice to businesses and organisations. Ioan is also Head of our Construction, Energy and Projects team and has spent almost 20 years advising clients on non-contentious and contentious construction matters. He has extensive experience in the construction and engineering sector and has acted in a number of high value and complicated disputes.

Ioan’s role involves advising the firm’s key clients on some of the most significant construction projects and disputes in Wales and the wider UK.

They are very practical in their approach: they provide us with pragmatic advice and help us and maximise our position every time.

Projects and contract advice

  • Advising a wide number of clients on procurement and construction issues including advice on the appropriate forms for procurement procedure (OJEU and non-OJEU) development agreements, advance work agreements, remediation contracts, demolition contracts, preconstruction services, two stage tendering, building contracts, consultant appointments, warranties and bonds.
  • Acting on behalf of a PPP Consortium in connection with a £225 million development involving housing, a primary school, community facilities and major infrastructure works. Advising on the Consortium agreement and all ancillary construction documentation.
  • Advising a consortium of three national house builders on a multi-million pound waterfront regeneration project. Advising on the joint venture agreement and all ancillary construction documentation.
  • Advising a number of RSL’s and public sector bodies on the procurement of framework agreements including a recent multi-million pound contractor framework using bespoke and industry standard forms.
  • Advising public sector bodies on planned and reactive maintenance services contracts, whether single or multiple supplier, using bespoke and industry standard forms.
  • Advising a number of public sector and developer clients on mixed use development projects including residential, office, commercial, retail and healthcare (GP practices/pharmacies/extra care homes).
  • Advising numerous clients in relation to renewable projects including solar, wind, biomass and anaerobic digestion.
  • Advising several local authorities in relation to the construction of multi-million pound school projects, one involving two-stage tendering.
  • Advising national government in relation to the construction of a bio-sciences facility.
  • Undertaking due diligence on behalf of banks and funders in relation to development funding.
  • Advising public sector bodies in relation to ECO agreements totalling four million pounds.
  • Advising numerous public sector bodies in relation to obligations including fair payment, KPI’s, community benefits, project bank accounts, BIM and blacklisting.

Dispute resolution

  • Representing central government in a multi-million-pound dispute with its design and build contractor on a new road building project.
  • Advising an education body on a dispute with its contractor relating to delay and defective works following the construction of a new education facility.
  • Advising a public sector client on a multi-million pound, multi-party action in relation to damage caused by demolition works undertaken by a contractor in a national road building scheme.
  • Advising a public sector client in connection with a multi-million pound claim arising from defective workmanship at a flagship building in Swansea.
  • Advising a housing association in relation to a claim on a performance bond following the insolvency of its contractor on a large residential housing project.
  • Advising a UK national contractor on a multi-million-pound final account dispute in relation to the construction of a new hospital. The claim involved issues relating to extensions of time, liquidated damages, disruption and loss and expense.
  • Advising a UK national contractor in a £2million multi-party dispute over defective works in relation to the construction of a lorry park.
  • Advising a UK national contractor on a professional negligence claim relating the design and construction of a multi-million pound university building.
  • Advising a UK national contractor on a multi-million pound dispute with its subcontractor. The key issues in dispute were extensions of time and the deduction of delay damages.

Development finance

Our banking team is experienced in acting for borrowers and lenders in relation to development finance facilities. We can assist with the production and/or negotiation of loan agreements (both in Loan Market Association and lender form) and security documentation tailored to development loans, as well as providing advice on construction documentation.

Welsh Rugby Union advised on Principality Stadium rooftop attraction SCALE

As long-standing legal advisors to the Welsh Rugby Union (WRU), the firm’s construction specialists led by Iwan Jenkins steered the negotiations with Pro Steel Engineering, ensuring all legal aspects were in place for the city-centre tourist attraction to open earlier this year.
