Iwan Jenkins

Iwan is a Partner in the Construction, Energy and Projects team and he advises on non-contentious construction matters. Iwan prepares and negotiates documentation on a wide variety of projects, including advising on building contracts, appointments, development agreements, construction security documentation and all associated documentation.

Iwan’s expertise includes advising public sector clients in social housing, education, local and national government as well as contractors, consultants, sub-contractors, developers and funders in the private sector.

Iwan has particular expertise in standard forms of contract (JCT, NEC, ICE, PPC, RIBA, BPF, ACE, CIC), construction documentation, single supplier and multi-party framework agreements, two stage tendering, development agreements and contract audit advice.

He has a particular interest in collaborative best practice and modern methods of construction. In relation to collaborative best practice he has advised employers and contractors on a number of areas including performance measurement, fair payment, project bank accounts and building information modelling (BIM). Iwan likes to keep at the forefront in relation to latest best practice.

Regarding modern methods of construction, Iwan has a keen interest in offsite manufacturing including modular and has advised both clients and contractors on contract strategy and risk allocation in relation to a number of modular housing projects.

Iwan has developed a particular expertise in large value project work and is currently advising a number of clients in relation to the Mutual Investment Model (MIM) in Wales.

He has experience in relation to asset management and has advised a number of clients on short and long term asset management contracts including planned and reactive maintenance, grounds maintenance, gas safety and facilities management contracts.

He has a particular expertise in relation to process plants contract and has advised on the FIDIC, ICHEME and MF/1 forms of contract for both clients and contractors on large multi-million pound projects.

Iwan advises on the health and safety aspects of CDM Regulations 2015 to a variety of clients. He has also advised on a number of renewable projects including wind, solar, anaerobic digestion for developers, contractors and funders. Iwan has expert knowledge of procurement law and best practice.

Work History

Iwan started his career, after graduating and spending a gap year working and travelling in 1995. He started his training contract at Bevan Ashford and qualified as a Solicitor in 1997. Iwan then moved to Morgan Cole in 1999, for almost 14 years, before becoming a Partner at Hugh James in 2013.

In addition to being a fluent Welsh speaker, Iwan is a former Board Director of Constructing Excellence in Wales and a member of the Forum of the Built Environment.
