Sexual harassment at work claims

Sexual harassment at work is a serious violation that can have a devastating impact on individuals and their well-being. This often goes unreported due to the individual’s wishes to remain in employment.

This can include things such as inappropriate emailing, contact out of working hours or inappropriate behaviour in general often passed over as “banter”.

We recognise the courage it takes to come forward and address such experiences especially when this can involve co-workers or employers.

Case Study

Sexual assault at work

Our client was sexually assaulted whilst placed with an agency who supplied medical professionals and services to the NHS. The perpetrator, a co-worker had previous allegations of sexual harassment. There was no police conviction; however, we were able to agree a settlement without issuing court proceedings. We are seeing increasing numbers of cases of sexual harassment and sexual assault within the workplace and are bringing more successful claims under The Equality Act 2010 in addition to vicarious liability claims.

Our clients

‘Banter’ was a guise for workplace harassment

We have recently successfully obtained a compensation settlement for a client involving a major recreational employer. Our client was subjected to inappropriate opportunist touching under the guise of ‘banter’ from her supervisor. The supervisor used sexual language and blew kisses. Our client felt she had no opportunity but to move site locations, impacting her career progression and even simply extending her commute. This impacted her mental health.

This case highlights the significance of addressing workplace harassment and the lasting impact it can have on an individual’s life.

Danielle Vincent, Senior Associate in the Abuse Team supported her client’s legal claim brought against the employer and successfully obtained a compensation settlement for her. The settlement signifies the employer’s responsibility for the actions of its employee, emphasising the need for employers to take proactive measures in fostering a safe and respectful work environment.

The financial compensation enabled our client to access private therapy, a vital resource that helped her cope with the distress and trauma she endured. Beyond monetary value, this case serves as a reminder that standing up against workplace harassment can lead to not only financial redress but also a significant step towards healing and empowerment for the affected individual.
