Damages for Mr W following mesothelioma diagnosis


Hugh James were instructed in August 2019 to investigate a mesothelioma claim on behalf of a gentleman who had been extensively exposed to asbestos throughout his working life. This included a mixture of roles such as working as a mechanic within the scrap metal trade and in factories.

The companies that Mr W had worked for were all dissolved, however following extensive research, including various traces for insurance and lengthy appeals for information, we were able to trace a policy of insurance which had been in place for PB Cow Industrials, a rubber factory based in Streatham. The insurers were notified of the claim, and accepted responsibility for Mr W’s illness shortly after. At this stage, an interim payment was obtained to help pay towards Mr W’s immediate care needs.

Time was spent thereafter calculating Mr W’s claim both as it stood and were the matter to be settled after he had died. Mr W confirmed that he would prefer to settle during his lifetime and settlement negotiations were entered into accordingly. The matter was concluded within a year of instruction, despite delays caused by the ongoing covid-19 crisis.
