Case Study: Mesothelioma settlement with provision for future treatment

Hugh James were instructed by Mr M who had recently been diagnosed with mesothelioma. Mr M had worked at Uskmouth Power Station for the CEGB between 1969 and 1995 and had come into contact with asbestos during his employment as an Auxiliary Plant Attendant.

His job involved monitoring and maintaining the boilers. There was a huge amount of pipework coming in and out of the boilers which was lagged with asbestos. The lagging was visibly in a poor condition and crumbled to the floor due to the extreme temperatures.

The defendant, RWE Generation UK Plc, admitted liability after sight of the letter of claim. An interim payment of £50,000 was secured for Mr M at this stage.

Hugh James went on to value Mr M’s claim and his claim ultimately settled for £210,000 gross.

Crucially, Mr M’s treating oncologist recommended that he may be a candidate for immunotherapy in due course. Hugh James were able to agree an indemnity with the defendant to ensure that they would cover any future, private treatment costs that Mr M may go on to incur.

Client, Mr M, said:

Everything about my claim has been handled superbly and I am very pleased that I chose Hugh James to handle the claim. The service was first class and Lauren did a wonderful job, always keeping me informed, and obtained a settlement I could have only dreamt of. I would recommend Hugh James to everyone. Thank you so much for everything.
